Breaking: Behind the Scenes of the Plea Deal in the Case of the Gaon and Tzaddik Rabbi Eliezer Berland shlit"a

Dudu Elkaim, who for years worked at the very forefront of the legal struggle to refute the false accusations against The Rav, the Gaon and Tzaddik Rabbi Eliezer Berland shlit"a, in a fiery and rare interview. “How does it feel—after you already managed to dismantle all the lies against the Rav shlit"a—and suddenly you’re going to a plea deal?” Dudu was asked.

“The feeling is very hard—not because the Rav shlit"a admitted anything, but because I know the Rav shlit"a is completely clean. The Rav took something upon himself that goes against our understanding. You can blame many people and say they pushed for the plea deal—and indeed all the attorneys, Rachel Toren, Adv. Feldman, and I along with them, opposed the deal vehemently. We had in our hands all the data that showed clearly that the Rav is clean beyond any doubt. But from the moment the Rav accepted it upon himself, we are in complete submission wherever the Rav is.”

“The Rav was updated on every detail of the investigative file, and he understood that after the 22nd of the month, the moment the evidentiary stage of the trial would begin, there would be a 180-degree turn in the case. The day before the plea deal I spoke with the Rav shlit"a, who explained to me in these words: ‘Dudu, I’m asking you—I must accept this upon myself.’ The moment the Rav told me that, I answered him: I am with you and I will do only what the Rav decides. I am with the Rav; I will always be. I didn’t say this out of fanaticism, but because I am almost the only one—together with a few other individuals—who knows the truth from the inside with certainty, and I say to the public absolutely, and I am prepared to do so even under oath with witnesses—

Rabbi Berland took upon himself things he did not do—consciously. But from the moment the Rav decided on this, our understanding is far too small to grasp why he accepted it. If I had Emunah in the Rav shlit"a before the plea deal, that Emunah has grown tremendously since then—because I know he accepted upon himself something that is beyond my comprehension and beyond the comprehension of all of Am Yisrael. We have no way to understand it.”

“The One Who examines kidneys and heart knows that I am saying my words in the most truthful way—and before the One Who knows that the Rav shlit"a is innocent: a harsh frame-up was woven against him, and we succeeded in unraveling it—practically the entire case. Against all the complainants who claimed they were afraid, we argued that they only needed to be afraid on the witness stand. I instructed Adv. Rachel Toren to obtain an order that would obligate all the complainants to come and testify. We had every tool to prove the Rav’s innocence beyond any doubt. That is why a very real storm is raging inside me—but I accept the Rav’s decision with complete submission.”

“The fabricated case against the Rav shlit"a was very complex. But the entire campaign of slander and filth that they pinned on the Rav was enough only to blacken his name and bring about an extension of his detention. Yet we knew—and the Rav shlit"a also knew—that a week after the trial began, he would be out. Our work was not only to free the Rav, but also to bring him out clean from this entire file.”

“They rushed to file an indictment because they knew that all the material they had was good only for blackening the Rav’s name, not for convicting him. And indeed, recordings were published online that reveal part of the truth. We don’t know who released those recordings, but it’s a shame it didn’t come out a week earlier.

In the recording you hear the head of the opponents, Yom Tov Chashin, literally whining that not a single complainant is willing to come testify.

This is the last complainant who still agreed to come testify—and now she too is not willing to come. From our side, we very much wanted her to come, because we refuted her entire web of lies and her husband’s as well. And even the police themselves knew clearly that these witnesses were not reliable—and that they coordinated testimonies under police protection and against the law. Believe me: if this couple had stood on the witness stand, it would have been the best show in town. What can you do when there is a Tzaddik here who accepted upon himself to sweeten harsh decrees from upon Am Yisrael?”

“The prosecution had nine confidential files of people who under no circumstances wanted to be exposed. I have no doubt that the moment those files were opened, their false testimony would have collapsed. But the Rav made his decision—and whoever understands that the Rav is the true Tzaddik must go with this decision wholeheartedly. The Rav sees things we do not see. We see with our eyes, and he sees with the eyes of the mind—from one end to the other.”

“Today attorney Rachel Toren passed me a message in these words: ‘My heart is burning; the case was heading to an acquittal.’ Moreover, attorney Naama Elhaddad went in to the Rav and, in tears, begged him not to admit and not to go to a plea deal, because next week he would be going home. But she said that the Rav lowered his face and said he knows—but he must take it upon himself.”

“The Rav has a truth that is above truth. But I am going to write a book about the truth behind the scenes, because according to the Shulchan Aruch it is forbidden for me to forgo the honor of the Rav shlit"a. Whoever reads the words of Chazal, the books of Rebbe Nachman, and the writings of true Tzaddikim, sees that the Rav shlit"a is a nonconventional Tzaddik—one the world cannot contain.
