Watch: Rabbi Berland's Giant Sukkah Under Construction

This morning, the Magistrate's Court rejected the petition filed against the construction of the Sukkah (temporary booth for the Sukkot holiday) of the Shuvu Banim community, headed by the Gaon and Tzaddik Rabbi Eliezer Berland shlit"a, and canceled the temporary injunction it had issued two days ago.
Attorney Itamar Ben Gvir presented maps to the court proving that maximum efforts were made not to disturb the family [the petitioners], including the placement of stewards, leaving an access route, and various permits for the construction of the Sukkah.
The municipality representative, Attorney Chaim Nargasi, was also summoned to the hearing and confirmed that the municipality allows the construction of Sukkahs for all Chassidic groups and did not see fit to discriminate against Shuvu Banim.
Attorney Ben Gvir told the judge that the background behind the request is the hatred of a very extreme faction toward Sephardim and ba'alei teshuvah (returnees to the faith), and emphasized that the legal status of the Shuvu Banim Chassidus (Chassidic group) is the same as that of the Gur, Belz, Boyan, and Karlin Chassidic groups.
Judge Mika Banki accepted Attorney Ben Gvir's arguments and canceled the injunction. At the same time, in light of the court's recommendations, it was agreed that the Sukkah would be shortened by several meters so as not to disturb the peace of the family from Neturei Karta.
Attorney Itamar Ben Gvir stated: "We are happy that the court accepted our arguments, recommended that the petitioner withdraw the request, and prohibited discriminating against this community compared to other communities. This is especially true since those behind the petitioners are motivated by racism and do not want Sephardim and ba'alei teshuvah (returnees to the faith) to reside in the neighborhood. Just as they tried to remove them from the central synagogue in the neighborhood and we succeeded in preventing them, we also succeeded in obtaining court approval so they can build a Sukkah like all other Chassidic groups."
